I gave up on trying to collect from someone that went bankrupt. I filed court papers but the process server couldn't find the guy. I guess I don't mind paying someone 30% if they can collect part of the debt -$200 is better than nothing.

I tried collection agencies for several accounts. One I got a judgement against for $400 but he still wouldn't pay. The collection agency will promise you alot but in the end, they never delivered.I don't know what kind of volume you have to give them to get them to go after someone but I know that the small number I gave them wasn't worth their time. Alot of talk but no action.

Get a couple of the biggest toughest looking male friends you can find and take them to the place that owes you. Have these big dudes start removing the sign ...... or a computer ..... or nice painting......and see how fast they come up with the bucks. Worked for me! Or....one company in Canada I did a bunch of decals for was also going out of business. They still owed me 4,000.00. Nothing worked. I called and was nice....I called and was mean....I sent letters......but guess what DID work??? I told them I am a single mom and it is Christmastime and my kids would not be having a very good Christmas. In 3 days I received a check for the total amount due. I have only been close to being burned twice. And they were the above mentioned, and I did finally get paid.

File the claim yourself. You can usually do it for less than $25. But.......
Getting judgement is just half the battle. Next is collecting. Did you hold their business responsible for payment, or did you hold them personally as well? Are they incorporated? Many times you will have to ask the court to do a debtor's exam. And even after that, it is still hard to collect. You can garnish wages if they are employed. You can place liens on real property if they have any.
If they filed for bankruptcy and your debt is included in that bankruptcy, you are simply placed on a list of creditors. Once the assets(if there are any) of that person have been seized/auctioned, the proceeds are supposed to be dispersed equitably among the list of creditors.
The laws, no matter how they are written, somehow weigh in favor of the deadbeats.
Good Luck!

Laura, What Dan said. If they have filed bankruptcy, you can't collect, nor are allowed to even ask to collect anything from the debtor. You should be listed as a creditor by the bankruptee and would be dispersed a percentage of the take from the court. Unfortunately, this is many times zip......

No one can find the guy. I would love to go get my sign back but I already called the police to ask about it and they told me that I couldn't get it-that AI would have to take him to court. Thats what started the court proceedings and thats as far as I got. I am not the only one looking for this guy.

I had an Amish fella order $700 signs for aug. 28th. About early Oct.they still hadn't been picked up so I went to the farm ....couldn't call!! His wife apologized up and down and offered me 1/2 now and the bal. when he picked them up as she shuffled around 7 kids. Can't help it, I left feeling somewhat relieved but GUILTY. However 2 days ago I decided to write a stern letter....stuck it in the mailbox.... went to the basement where I was using a jigsaw. The dogs were going wild upstairs, when I finally peeked up.... low and behold it was the amish fella! Thank goodness the mail hadn't went yet! Too bad you couln't write him a semi-bitchy letter...worked for me.

Robin, you seem to have Murphy's lew calibrated just right. I seem to be about a half a day out of sync. I always get checks in the mail that I called to grumble about earlier that same day. Of course they are about 2 weeks late when I call, but I wish I had waited another day to make the call.
