New church in town has someone online do a logo for them. They don't like it and hires me to do new logo, signs, stationary package, keychains, mugs...everything.
I listen to what the Pastor is trying to convey and he wants some hands cupped with a seedling in the hands. I have someone take a picture of my hands cupped, vectorize them, put a seedling in them and a box around with clipped corners.
The committee loves it and wants to add this to the copy. This is fine and dandy and they start using it.
I get a call today from the gentleman that I have been working with and he says that his wife calls him. It seems that she is in Meijers shopping and in the Organic section is this graphic almost identical. Supposedly the hands are not cupped but flat with palms up and a 3 leafed seedling is in them (mine is 4 leaf).
What would you do?

Check to see if it's registered for trademark. If not, get yours registered ASAP so there's no legal issues. Then start working on a different logo.

Trademarks are divided by the patent office into categories. This allows for similar work to be protected by category classification. In short, a church has nothing to do with organic gardening so there is little or no chance of infringement.

Fred is right. I wouldn't worry about it. If anything, just do what Bill said and move on to the next headache. You gave the pastor exactly what he requested and you created it from the ground up.

You germinated your own seedling- well done! There are similar logos here (downunder), and there will continue to be similar logos, as the idea/image is a good one.

make sure it's dated and documented. The Interlectural Property Law prevails.
