Snap as many Pictures as you can of the Mural and make it know to the customer that you would like a percentage of (Any copying of Artwork..)

I'm definitely in the minority with my views on the rights and proceeds of murals. But it has been born out with the expereience of painting about a hundred murals in locations across North America.
I generally charge a design fee up front. I charge to paint the mural. This is generally done under contract with the rights to the mural sold to the folks who comission the mural as part of the deal. I retain the rights to reproduce the mural for my own self promotion.
I charge them good for the rights of the mural. They can do whatever they want after that... who cares... as long as they include my name on the artwork.
Most often they have far loftier dreams of potential income than will ever materialize. If by chance they do a good job and make a ton of money in the process... well good on them. They are also promoting my name while doing it.
To take the trouble of monitoring a percentage fee for anything they might produce would be a headache I wouldn't want. Would it be on the cost to produce... potential retail... wholesale... when sold??? Who knows, who cares!
I'd rather take a fee up front for the rights which is included with the fee for painting the mural.
It allows me to move on to the next project instead of worrying about what I may or may not be missing from past projects.
Be confident about your work and it's value. Use the 'rights' of the work to increase its value at the beginning of the negotiations. Then move on!

A Songwriter will get percentage from their material........... As it is played (Day after Day.) Go and try to copy the Mona Lisa?
We are talking about Murals/Pictorials....? not the Plan-Jane lettered signs...Right?

I have done exactly what Dan does. The customer pays for the design and it's theirs to use in any promotion, sales of souveniers etc. As long as they are never reproduced on another wall hahahahha.
The Town of Millmerran where I did the 7 historical murals, including the big water tank, produced a pictorial leaflet (including my name!) which they sent to every motel within 500 miles. Also fridge magnetics and post cards which have sold well. Profits went to the local historical society.
As Dan says ... it's an almost impossible task to police or collect royalties. The publicity I have got is worth more than that anyway.
At least, so far, I have always been asked for reproduction rights:)
